Intellectual property

Unless indicated otherwise, all intellectual property rights to this website and the Information are owned by Heineken. These rights include but are not limited to all copyrights, rights to the trade names, word trademarks, pictorial trademarks and logos of Heineken, such as, but not limited to the rights to "HEINEKEN".

Users are permitted to read this website and the Information and make copies for their own personal use, for example by printing or storing. All other use of the website or of the Information, for example the storage or reproduction of (a part of) the website of Heineken in any external internet site is not permitted.

Unsolicited ideas

In the event that you post unsolicited ideas and/or materials whether consisting of texts, images, sounds, software, information or otherwise (the "Materials") on this website or send such Materials to Heineken by email or otherwise, Heineken shall be entitled to use, copy and/or commercially exploit such Materials to the fullest extent and free of charge. Heineken shall not be bound by any confidentiality obligation in respect of such Materials.

You hereby indemnify and hold Heineken harmless from and against all actions, claims and liabilities, suffered, incurred or sustained by Heineken as a result of the use and/or exploitation of the Materials infringing the (intellectual property) rights of any third party or otherwise being unlawful towards a third party.

Severability

If these Terms of Use are or become partially void, the parties will continue to be bound by the remainder of the same. The parties shall replace the void part by provisions that are valid and have legal effect that correspond with those of such void part as much as possible, taking into account the content and the purport of these Terms of Use.

Applicable law and jurisdiction

These Terms of Use shall be exclusively governed by Law of the Netherlands. All disputes arising in connection with these Terms of Use, including but not limited to disputes concerning the existence and validity thereof, shall be resolved by the competent courts of Amsterdam.

Those accessing the Website from other jurisdictions are responsible for compliance with local laws if, and to the extend that, local laws are applicable.

Heineken UCL Promotional Packs 2011

Acceptance of the rules is a condition of entry and entry instructions form part of the rules. Entry indicates acceptance of terms and conditions.

  1. Open to UK residents (including Channel Islands and Isle of Man) aged 18 or over, excluding employees and their immediate families of Heineken group, its agents or anyone professionally associated with this promotion.
  2. This promotion is available on special promotional bottle packs of Heineken 33cl 4 packs, 6 packs & 12 packs while stocks last. The barcode can be found on the side of the packaging.
  3. To enter go online at heineken.com and follow instructions to enter the last 4 digits of the barcode from either Heineken 33cl 4, 6 and 12 bottle packs only and personal contact details.
  4. Entries must be made personally. One entry per email address per code per day. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of 'script', 'brute force' or any other automated means, that person's entries will be disqualified and any prize award will be void. No entrant may win more than one prize.
  5. Prize draws of all valid daily entries will take place daily after midnight between 14th February 2011 and 1st July 2011. Winners of the daily draw will be first valid entry drawn at random and will win either one of the following prizes 3D Televisions, Wall projectors, Heineken branded drinks trays, Heineken UCL branded glasses and UCL Highlights DVDs or a pair of tickets to the UEFA Champions League final at Wembley Stadium, London on 28 May 2011. All tickets prizes can only be won from 14th February – 6th May 2011. All non-ticket prizes can be won from 14th February – 1st July 2011. Prize allocation is at the discretion of the Promoter and no correspondence will be entered into. The total daily prize fund includes 4 3D Televisions, 19 Wall projectors, 137 Heineken branded drinks trays, 274 Heineken UCL branded glasses, 137 UCL highlights DVDs and 2 pairs of standard tickets to the UEFA Champions League Final. Winners and winner’s guest must be aged 18 years or over.
  6. All valid daily entries received before midnight on the 6th May 2011 will be entered into a main prize draw to win a pair of VIP Champions League final passes, to be drawn on 7th May 2011. There are 10 pairs of tickets to be won. These winners will be the first ten valid entries selected at random under independent supervision. These pairs of VIP UEFA Champions League tickets are for the final at Wembley on the 28th May 2011 and include pre match hospitality at Marylebone location, train travel to Wembley, premium seats at the match and train travel back to Marylebone venue afterwards. One of these winners will also be chosen at random to receive the back stadium tour and the opportunity to go pitch side after the match. This winner will be the first valid entry selected at random under independent supervision. The pair of UEFA Champions League final VIP back stadium passes consists of 1 pair of tickets to the final at Wembley on the 28th May 2011. It also entitles the winner and 1 guest to pre and post match hospitality, have a stadium tour approximately 3 hours before kick off with the opportunity to go pitch side after the match.
  7. Ticket winners will be contacted via email within 72 hours of the relevant draw.
  8. Ticket winners must claim their prize by responding to this email with their address details within 7 days of notification. If there is no response after this time, the Promoter will offer the unclaimed prize to a substitute winner selected at random by computer from all remaining valid entries. Upon receipt of proof of age, and address details, ticket winners will be sent a confirmation letter including details on collection of the tickets and the match day itinerary.
  9. All UEFA Champions League final tickets must be collected by the winner at a location in London which will only be shared with winners in the confirmation letter, here a Heineken representative will arrange to meet them, check identification and provide their tickets and passes if relevant. Transport will be provided to get from this designated location to the match and back to this location after the match.
  10. All UEFA Champions League final tickets do not include any travel to London, accommodation or subsistence to get to the match. This is the responsibility of the winners and their guests.
  11. All tickets are 18+ tickets and are non-transferable, re-saleable or exchangeable. Wembley Stadium Terms and Conditions apply. Visit www.wembleystadium.com for more details.
  12. Non-ticket prize winners will be contacted by telephone within 48 hours of the relevant draw. Upon receipt of proof of age, and address details, the prizes will be sent out to reach the winners within 28 days of notification.
  13. The decision of the Promoter is final. No correspondence will be entered into.
  14. Purchase is necessary for England, Wales, IoM, and CI residents. Purchase is not necessary for Northern Ireland & Scotland residents. To enter without purchase send your name, address and postcode on a self-addressed envelope to HUCL Promotion NPN, Heineken UK Ltd, 2-4 Broadway Park, Edinburgh EH12 9JZ.. You will be entered into the draw on the day your entry is received. No bulk or third party applications will be accepted. No purchase entries are limited to one per household.
  15. Responsibility is not accepted for entries lost, damaged or delayed in the post or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
  16. The Promotion closes at midnight on 6th May 2011 for ticket prizes (standard and VIP) and 1st July 2011 all non-ticket prizes.
  17. The Promoter is not responsible for any third party acts or omissions. The Promoter accepts no responsibility for any technical issues, system or software failures encountered on heineken.com or during entry into the promotion. We try to ensure the standard of the Site remains high but we cannot be held responsible for interruptions of service. The Promoter reserves the right to suspend temporarily the operation of the Site without notice in the case of system failure, maintenance or repair or for any other reason beyond its control. You are responsible for all Internet connection costs charged by your service provider. If you do not pay the bill please get permission from the person who does.
  18. The promoter reserves the right to cancel or amend the promotion due to circumstances outside its control. The promoter is not responsible for any third party acts or omissions.
  19. We cannot guarantee that the event will be free from disruptions, failings or cancellations. We are not liable for such disruptions, failings or cancellations unless they are caused by our negligence. Any requests for refunds or compensation arising from them should be sent to the operator of the event. We can provide you with their details on request.

  21. Prizes are non-transferable and no cash or date alternative is available. However, the Promoter reserves the right to award similar alternative prizes of equal or greater value in the event of circumstances outside of its control.
  22. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. Incomplete or illegible entries or those not in accordance with the entry instructions will not be accepted.
  23. The winners may be required to take part in any publicity accompanying or resulting from the main prize draw and weekly draws. No compensation shall be awarded for such participation.

Star Player Terms and conditions of Use

Introduction

  1. These terms and conditions (“Terms of Use”) apply to "Star Player" (hereinafter: the “Game”) and to all use of the Star Player Application(the “Application”), as well as to all Content and/or Services provided to you on or through the Application (the “Information”). “Content” includes all text, graphics, images, audio, video, software, data compilations and any other form of information that appears on or forms part of the Application. “Services” include all online facilities, communication infrastructure, services, tools or any other information that is made available through the Application.
  2. The Game is offered by Heineken UK Limited, 2-4 Broadway Park, South Gyle Broadway, Edinburgh EH12 9JZ.
  3. ALTHOUGH HEINEKEN HAS TAKEN EVERY EFFORT TO PROMOTE COMPLIANCE WITH APPLICABLE LEGISLATION, HEINEKEN CAN MAKE NO REPRESENTATION THAT THE GAME OR THE INFORMATION IS APPROPRIATE FOR USE IN JURISDICTIONS OTHER THAN IN THE NETHERLANDS. At any time Heineken has the right to, at its sole discretion and without prior notification, change or discontinue any aspect or feature of (the set-up of) the Game and to change or modify the Terms of Use, or any part thereof, or to impose new conditions. The action period is initially the Group Stages of the UEFA Champions League matches during the season 2011/2012, taking place on 13 and 14 September 2011 (match day 1), 27 and 28 September (match day 2), 18 and 19 October 2011 (match day 3), 1 and 2 November 2011 (match day 4), 22 and 23 November 2011 (match day 5) and 6 and 7 December 2011 (match day 6) from 19:15 GMT until 21:45 GMT, including possible injury time of each match (the "Action Period"). The action period will then move onto the round of 16, followed in order by the quarter finals, semi-final and final
  8. Facebook and Apple are not a sponsor or administrator, or in any way associated with the Game.
  9. THE GAME IS NOT A SWEEPSTAKE, LOTTERY OR GAME OF CHANCE OF ANY KIND.

Participation

  1. YOU ARE ONLY ELIGIBLE TO ENTER THE APPLICATION OR PLAY THE GAME OR USE THE INFORMATION IF YOU ARE ABOVE 18 YEARS OLD.
  2. NO PURCHASE OR PAYMENT IS NECESSARY TO PARTICIPATE IN THE GAME.
  3. At all times Heineken has the right to, at its sole discretion and without prior notification, exclude you from participation. Circumstances in which Heineken can exclude you from participation include but are not limited to, non compliance with these Terms of Use or attempts to compromise the Game in any way.

    • Quarter Finals – 27 and 28 March 2012
    • Quarter Finals – 3 and 4 April 2012
    • Semi Finals – 17 and 18 April 2012
    • Semi Finals – 24 and 25 April 2012
    • Final – 19 May 2012
  2. Kick-off time of these matches is scheduled for 19:45 GMT (“Kick-Off”). The Game begins after Kick-Off and ends at the end of the football match, including injury time.
  3. The Game administrator shall control the official time stamp for the purposes of determining the validity of the answers submitted.

How to participate

  1. You can participate in the Game, through the following channels, which are:
    • Through the Application on the Heineken Fan Page on Facebook. You must have a Facebook profile and ‘Like’ the Heineken Fan Page on Facebook;
    • Through the Application on iPhone (versions iOS 3.x up to iOS4.1). You must first download and install the free iPhone application from the iTunes App Store;
    • Through a direct link (url) to the Star Player application on the Heineken.com website;
    • Through a private league invite.
    Participation in the Game is limited to 30 minutes before Kick-Off until 15 minutes after the end of the football match.

How to play

  1. During the football match, live game questions about match moments (“Live Match Moments”) and multiple choice bonus questions (“Bonus Questions”) will be asked.
  2. Live Match Moments: When a penalty, free kick or corner is taken, you need to predict where the ball will land, before the question countdown is over. If you see the live result before the countdown is over, your answer will not be accepted.
  3. Bonus Questions: You need to answer these questions that test your knowledge of the nations that compete in the UEFA Champions League, before the question countdown is over.
  4. You score points for your correct answers on the Live Match Moments and Bonus Questions. The quicker you submit your correct answers on the Bonus Question, the more points you score.
  5. You also score points with a click on the button “Goal”, when you think there will be a goal in the next 30 seconds and your prediction is correct. The maximum number of times that you may click on the button “Goal” is 8 times plus an extra "Goal" chance Power Up to use in every match (see under 5.6.: Goal).
  6. At the start of each match you will be awarded with 3 Power Ups:
    • Max Points: you score maximum points for the correct answer on 1 Bonus Question of your choice;
    • 50:50: Game operator eliminates two incorrect answers on 1 Bonus Question of your choice, leaving you with a choice between the correct answer and one incorrect one from which to select;
    • Goal: you may click one extra time on the button “Goal”;
    Power Ups are valid for one match only.
  7. All decisions regarding points scored in the Game will be made exclusively by Heineken, whose decisions are final and binding on such matters.
  8. Private League
    You can create or join a private league to play with a maximum of 25 persons. You can invite your Facebook friends through Facebook ("Facebook Friends") or email. You stay part of the global league when entering a private league. It is not required to create or join a league to play the Game.

Prizes

  1. One prize, of a pair of tickets to a UK based UEFA Champions League game will be awarded to the person at the top of the UK Leader Board at the end of each of the following stages;
    • Match Day 1 – 13 and 14 September 2011
    • Match Day 2 – 27 and 28 September 2011
    • Match Day 3 – 18 and 19 October 2011
    • Match Day 4 – 1 and 2 November 2011
    • Match Day 5 – 22 and 23 November 2011
    • Match Day 6 – 6 and 7 December 2011
    • Round of 16 – 14 and 22 February 2012
    • Round of 16 – 6 and 14 March 2012
    • Quarter Finals – 27 and 28 March 2012
    • Quarter Finals – 3 and 4 April 2012
    • Semi Finals – 17 and 18 April 2012
    • Semi Finals – 24 and 25 April 2012
    • Final – 19 May 2012
  2. Exact fixtures to which the winner’s tickets will be valid will be confirmed as the tournament progresses. The winner and their guest must be aged 18 years or over. The prize consists of match tickets only, and does not include accommodation, transport, or other subsistence. Any such cost must be borne by the winner and their guest.
  3. The winners will be notified by email by the Friday immediately following the end of each phase. Failure of the winner to respond to the email notification within 48 hours will be deemed that the winner has forfeited their chance to win and the runner up will be contacted to accept the prize. Verification that the winner and their guest are aged 18 years or over will be required before the prize is given. At this point the date and venue to which the tickets apply will be communicated to the winners.
  4. There is no cash or other alternative to this prize in whole or in part, but the promoter reserves the right to substitute the prize of an equivalent value should the prize become unavailable for any reason.
  5. Prize is not transferable.
  6. The winner’s names and county of residence will be published on the Star Player site by the following dates; • Match Day 1 – 16 September 2011

    • Match Day 3 – 21 October 2011
    • Match Day 4 – 4 November 2011

    • Final – 25 May 2012
    The winners will be required to participate in all required publicity, including any presentation ceremony.
  7. The decision of the promoter in all matters is final and binding and no correspondence will be entered into.
  8. We cannot guarantee that the event will be free from disruptions, failings or cancellations. We are not liable for such disruptions, failings or cancellations unless they are caused by our negligence. Any requests for refunds or compensation arising from them should be sent to the operator of the event. We can provide you with their details on request.

Leader Boards

  1. The Global Leader Board shows the ranking of the points scored by all registered participants of the Game. The League Leader Board shows the ranking of your Private League. The Facebook Friend Leader Board shows the ranking of your Facebook Friends.
  2. To enter your score into the Leader Boards you need to register. Data you need to provide include your (nick)name, valid e-mail address and true age. Registration to enter scores is possible, at any point during the Action Period.
  3. Heineken reserves the right to change rankings on the Leader Boards. In the event of a tiebreaker situation (two similar scores), the participant who submitted most correct answers on the Bonus Questions will obtain the first ranking. Should there be still any tiebreaker situation, the participant who submitted his answers on the Bonus Questions the fastest will obtain the first ranking.
  4. You agree that your score will appear on the Star Player Global leaderboard if you play on heineken.com, Facebook or via the iPhone app but you will not be eligible to win prizes under the Star Player Global Competition.

Release

  1. YOU HEREBY AGREE TO INDEMNIFY AND HOLD HEINEKEN, FACEBOOK AND APPLE AND EACH OF THEIR SUBSIDIARIES, AFFILIATES, RELATED COMPANIES, ADVERTISING AND PROMOTION AGENCIES AND EACH OF ITS AND THEIR RESPECTIVE DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES (THE "RELEASED PARTIES") HARMLESS FROM AND AGAINST ANY LOSSES, DAMAGES, RIGHTS, CLAIM, OR CAUSE OF ACTION OF ANY KIND ARISING, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, OUT OF PARTICIPATION IN THE GAME, INCLUDING CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND PRIVACY RIGHTS.

Liability

  1. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, THE RELEASED PARTIES SHALL NOT BE LIABLE AT ANY TIME FOR ANY DAMAGES, LOSSES, AND CAUSES OF ACTION, RESULTING FROM THE USE (OR INABILITY TO MAKE USE) OF THE APPLICATION OR THE GAME OR ANYTHING CONNECTED WITH IT, INCLUDING DAMAGES, LOSSES, AND CAUSES OF ACTION CAUSED BY VIRUSES OR ANY INCORRECTNESS OR INCOMPLETENESS OF THE INFORMATION, UNLESS SUCH DAMAGE IS THE RESULT OF ANY WILFUL MISCONDUCT OR GROSS NEGLIGENCE ON PART OF THE RELEASED PARTIES.
  2. THE GAME AND THE APPLICATION ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. Intellectual property

  1. Unless indicated otherwise, all intellectual property rights to the Application and the Information are owned by Heineken. These rights include but are not limited to all copyrights, design rights, rights to the trade names, word trademarks, pictorial trademarks and logos of Heineken, such as, but not limited to the rights to "HEINEKEN".
  2. Users are permitted to read the Application and the Information and make copies for their own personal use, for example by printing or storing. All other use of the Application or the Information, for example the storage or reproduction of (a part of) the Information of Heineken in any external internet site or the creation of links, hypertext links or deep links, is prohibited without the express written consent of Heineken.

Material Postings

  1. In the event that you post unsolicited ideas, opinions, statements, content of any messaging or other materials consisting of text, graphics, images, audio, video, software, data compilations or other materials (the “Material”) on the Application and [associated discussion groups, bulletin boards, chat rooms], or send such Material to Heineken by email or otherwise, Heineken shall be entitled to use, copy and commercially exploit such Material in whole or in part, in any form, to the fullest extent and free of charge. Heineken shall not be bound by any confidentiality obligation in respect of such Material.
  2. YOU HEREBY INDEMNIFY AND HOLD HEINEKEN HARMLESS FROM AND AGAINST ALL ACTIONS, CLAIMS AND LIABILITIES, SUFFERED, INCURRED OR SUSTAINED BY HEINEKEN AS A RESULT OF THE POSTING, USE OR EXPLOITATION OF THE MATERIAL INFRINGING THE (INTELLECTUAL PROPERTY) RIGHTS OF ANY THIRD PARTY OR OTHERWISE BEING UNLAWFUL TOWARDS A THIRD PARTY.
  3. When using the Application or posting Material you must not post Material:
    • that violate these Terms of Use or any applicable laws or any other regulation, guideline or community standard;
    • that is obscene or otherwise objectionable, vulgar, abusive, threatening, harassing, defamatory, sexist or racist;
    • that is intended to promote or incite violent, dangerous or antisocial behaviour.
  4. Heineken is not required to pre-screen any Material that is posted on or through the Application and [associated discussion groups, bulletin boards, chatrooms], although Heineken reserves the right to do so at its sole discretion and without prior notification.
  5. Heineken reserve the right to remove Material, at its sole discretion and without prior notification, that, does not meet its standards or does not comply with these Terms of Use, but Heineken is not liable for any failure or delay in removing such material.

Information and Material of others

  1. The Information and Material originating from third parties constitutes an expression of the personal opinions of those third parties. Heineken is not responsible and shall not be liable for such Information and Material.
  2. Hyperlinks on this Application may direct visitors to external websites which are maintained by others. Heineken shall not be liable for the contents and the functioning of such external websites. Heineken shall also not be liable for the quality of products or services which may be offered on such external websites.

Privacy and data protection

  1. The personal data provided by you in the context of this Game will be collected and processed by Heineken in accordance with our privacy and cookie policy.

Comments and/or complaints

  1. During the Action Period you may express your complaints concerning the Game and Terms of Use by sending an e-mail to webcenter@Heineken.com stating your name, address, e-mail address and telephone number. Heineken will thereupon contact you within a reasonable time after the date of delivery. Heineken will not take up correspondence regarding the ranking on the Leader Boards.

Severability

  1. If these Terms of Use are or become partially void, the parties will continue to be bound by the remainder of the same. The parties shall replace the void part by provisions that are valid and have legal effect that correspond with those of such void part as much as possible, taking into account the content and the purport of these Terms of Use.

Applicable law and competent court

  1. These terms and conditions shall be exclusively governed by UK law. All disputes arising in connection with these terms of conditions, including but not limited to disputes concerning the existence and validity thereof, shall be resolved by the competent courts of the United Kingdom.
