TERMS AND CONDITIONS INSTAGRAM 12THWOMAN PROMOTION

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions.  Please retain a copy for your information.

 

The personal data provided by entrants will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at https://www.heineken.co.uk/legal-hub/brands-privacy-policy).  From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the promotion and contacting entrants (as necessary) and/or fulfilling the prize(s).

 

1. The Promotion
● The Promoter is Heineken UK
● The promotion is available on Instagram with influencers, where followers are invited to post reels/photos around the #Iamthe12thwoman. The Promotion is open to residents of the United Kingdom aged 25 or over, excluding employees of any company in the HEINEKEN group and any person whom, in the Promoter’s reasonable opinion, should be excluded due to their involvement or connection with this promotion.
● Promotion Period: Friday 15th and Wednesday 27th July 2022.
● To Enter: To take part in the promotion,
● Have a public Instagram profile;
● Post on Instagram a Reel or Photo as directed in the influencer’s content either wearing the 12th woman t-shirt or with it written somewhere visible in the image
● Use the hashtags and tags #Iamthe12thwoman and @heineken_uk
● Be aged 25 years or older


2. Conditions
● Maximum of 1 entry per person.
● Entries must be made personally. Entries made through agents/third parties, bulk entries or automated entries are invalid. Entries submitted via any other means will not be accepted. The Promoter cannot guarantee uninterrupted or secure access to the web entry route.
● Purchase of Heineken beer to participate in the Promotion is not necessary.

3. Use of the Content
By entering the Promotion, all Entrants hereby grant the Promoter (or the Promoter’s designee) a non-exclusive, non-revocable, royalty free, perpetual, worldwide licence to use the Content of the Entrant and related social media handle on the Promoter’s websites and/or on any of the Promoter’s social media platforms. The Promoter may use, reproduce, distribute, combine with other materials, alter and/or edit the Content in any manner in its sole discretion. They also agree to other possible promotional use of the Promoter’s choosing without any further payment over and above the award of the prize with appropriate credit given to the original Entrant. Copyright and other intellectual property rights will remain with the Entrants.
The Promoter is under no obligation to use Content entered by Entrants. The Promoter reserves the right to remove the Content at any time.
The content must comply with the following guidelines, which relate to HEINEKEN’s Responsible Marketing Code, including:
- Adult appeal: content should not depict minors (below 18) nor should they appeal to minors, for example by depicting cartoons, toys, music and styles that do not have an adult appeal;
- Ethical: no use of stereotypes and humour related to age, disability, gender, race, religion or sexual orientation.
- Do not depict excess alcohol consumption.
- Do not drink and drive.
- Do not depict anti-social or dangerous behaviour.
- Do not make a link between consuming beer and having social or sexual success.


4. The Prize
One prize, consisting of two tickets to the UEFA Women’s Euros Final on 31st July at Wembley stadium.
The Prize shall be subject to government COVID-19 travel restrictions in place at the relevant time. Due to the nature of the Prize, the Promotor cannot offer alternative dates and locations.

 

5. Prize Conditions
• The Prize is not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason any element of the Prize is not available, the Promoter reserves the right, at its sole discretion to substitute that element for another of similar value.
• The Winners and their companions must be aged 25 or over
• Winners are liable for all travel & accommodation expenses

 

6. Winner Selection
Winners will be selected by the Heineken UK social media team. The winner will be selected at random, ensuring they are compliant with entry requirements.
The decision is final. The winner will be chosen from all qualifying entries on 28th July 2022.


7. Winner notification
The provisional winners will be contacted via the Instagram profile from where the content was posted within 1 day of the Winner Selection being completed. Once eligibility has been confirmed and they have accepted the Prize, the winners will then be confirmed as the winner. Reasonable efforts will be made to contact the winner. If the winner does not respond to the initial contact within 12 hours, or they are deemed ineligible to accept the Prize, the Promoter reserves the right to select another winner and contact them as above until a winner who can accept the prize is found.


8. Prize Acceptance
The winners will be notified immediately following acceptance of the Prize to arrange fulfilment of the Prize. Considering the timings of this competition, in the unlikely event that a winner has not received communication or has not responded to arrange their prize within 12 hours of Prize Acceptance, the Promoter reserves the right to not reissue the Prize or limit its value at its sole discretion.


9. Privacy and personal data
All personal data provided for this Promotion will be used solely for the purpose of this Promotion by the Promoter and/or by any agent appointed by it to assist with running the Promotion, and will not be disclosed to an unconnected third party unless the Entrant’s positive consent has been obtained. Entrants’ personal data will be handled in accordance with the Promoter’s privacy policy, available at https://www.heineken.co.uk/legal-hub/brands-privacy-policy


10. Rejection of entries
The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If an Entrant behaves in a way that is not consistent with these Terms & Conditions, their entry (and any of their associated aliases) will be disqualified, any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar the Entrant from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
i. verify the eligibility of Entrants and/or provisional winners by requesting such information it considers reasonably necessary for this purpose. Award of a Prize may be withheld unless and until verification is completed satisfactorily.
ii. disqualify any entries that are not made directly by the individual entering the Promotion but by using anonymous email services such as GuerillaMail, Dispostable or Mailinator, bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means;
iii. reject any entries that are in breach of the Terms & Conditions, contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;
iv. reject any entries that contain or refer to any third-party brand or reference any third-party names, logo and/or trademarks.

11. Miscellaneous
• The Promoter shall not be liable for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical or other reason. Proof of sending will not be accepted as proof of receipt.
• The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damages suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
• The Promoter shall not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances of the Promoter.
● If any part(s) of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
● By entering, Entrants will be deemed to have agreed to be bound by these Terms & Conditions.
● If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
• These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with the laws of UK.
