HEINEKEN SILVER BOTSWANA ULTIMATE VIP CAPE TOWN MUSIC FESTIVAL EXPERIENCE CAMPAIGN
- 1. Introduction
- 1.1. This promotional competition is organised by HEINEKEN Beverages Botswana Ltd (“the Promoter”).
 - 1.2. The promotional competition is open to permanent residents of Botswana, who holds a valid Botswana Passport that is valid for at least three months after scheduled departure date over the age of 18 years except any employee, director, member, partner, agent or consultant or any person directly or indirectly, who controls or is controlled by the Promoter, immediate family members, advertising agencies, advisers, dealers, suppliers and/or associated companies, and/or a participant who has won a prize through a promotional competition run by the Promoter at least three months prior to the announcement of the winner of the Prize (“Disqualified Persons”).
 - 1.3. By entering the promotional competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding. Upon approval from Gambling Authority the Promoter reserves the right to amend, modify, change, postpone, suspend, or cancel this competition and any prizes (which have not yet been subject to a draw). In such cases, the participants will be notified.
 
 
- 2. Duration and how to enter
- 2.1. The promotional competition commences on 01 October 2025 and ends on 31 December 2025, both days inclusive. Entries received after the closing date will not be taken into consideration
 - 2.2. Participants stand a chance to win one of 3 Double Tickets x Ultimate Vip Cape Town Music Festival Experience including flights, accommodation and VIP Music Festival Tickets (“the Main Prize”) *Please note: Winners must have a valid Passport with at least three months validity remaining from the scheduled departure date in order to qualify for this prize; OR 6 participants stand a chance to win BWP20,000.00 iStore Botswana voucher (“Store Voucher”), awarded on a monthly basis over the duration of the campaign. 2 winners will each receive 1 Store Voucher in the months of October, November, and December, respectively.
 - 2.3. To qualify for the Prize, participants must purchase any 6 pack of Heineken® Silver 330ml NRB or 500ml Can in any participating store, scan the QR code (which will redirect to a WhatsApp link) on the POS provided once the promotional deal is purchased and follow the prompts to enter the competition. Participants may enter the competition multiple times to increase their chance of winning however each entrant can only win one prize. Only one entry is permitted per valid till slip, multiple entries using the same slip will not be accepted.
 - 2.4. Monthly Store Voucher winners will be determined by random draw from all the entries received during that month and notified by the Promotor or its nominated agent by telephone by no later than the following Wednesday.
 - 2.5. Winners will be determined by a random digital draw from all the entries received during the competition terms and notified by the Promoter by telephone/WhatsApp and/or SMS. The main prize draw will take place on 31 January 2026. At this draw event, 3 lucky winners will be randomly selected. The draw will be held at Game City Rooftop, Marquee, Gaborone starting at 14:00hrs, where 3 lucky winners will be drawn digitally. The Store Voucher draws will take place as follows each month i.e. October 27th at Liquorama Setlhoa, November 29, Park 27 Restaurant and December 20th, Capello Molapo. The 3 draws associated with the iStore vouchers will start at 15:00hrs on the scheduled dates.
 - 2.6. The draws will be held in public spaces, allowing for transparency and fairness in the selection process. Participants and interested parties are welcome to attend and witness the draw, which will determine the winners of the competition. The decision is final, and no correspondence will be entered. All prizes are non-transferrable and cannot be exchanged for cash.
 - 2.7. Once each winner has been contacted, they will be given a letter to confirm that they are the winners of the prize on the letter there will be given details of location, date and time of collection of the prize.
 - 2.8. Winners will need to provide their proof of identity to verify that they meet the age requirements specified (18 years of age and above).
 - 2.9. If the potential winners do not claim their prize or submit the required information within 90 days of notification, and all means have been exhausted, the potential winner(s) will be deemed to have rejected the prizes, and it shall revert back to the Promoter upon the approval of Gambling Authority.
 - 2.10. Winners accept that the Promoter, may, at its own discretion publicise the names of the winners. Winners grant permission for the Promoter to use their names and photographs in any advertising and promotional material for this promotional competition. Winners may ask that their names be removed or refuse to take part in any publicity. Participants and Winners will not receive any payment for taking part in the promotional competition or taking part in any media format related to it. All and any materials, including publicity materials will be the sole property of the Promoter.
 - 2.11. All participants and winners indemnify the Promoter, its authorized agents, and associated partners against any claims arising from their own negligent or unlawful acts committed during participation in the promotional competition or use of the prize. This indemnity does not extend to claims arising from the negligence, misconduct, or misrepresentation of the Promoter or any of its agents and does not exclude or limit liability where such exclusion is prohibited under applicable law or consumer protection standards.”
 
 
- 3. Social media platforms
- 3.1. If social platforms are used for this promotional competition, it is hereby declared that the promotional competition is in no way sponsored, endorsed, or administered by, or associated with WhatsApp, Facebook, Instagram or any other social media platform that may be used to promote the competition. Participants acknowledge that they are providing information to the Promoter and its agents only and not to WhatsApp, Facebook, Instagram, or any other social media platform.
 - 3.2. Where applicable, all participants in this promotional competition release WhatsApp, Facebook, Instagram, and all other social media platforms of all liabilities for and claims arising out of or in connection, including any damage you may suffer with this promotional competition and these terms and conditions.
 
 
- 4. Dispute resolution 
- 4.1. The Promoter’s decision is final, and binding and no correspondence will be entered into if any dispute arises in relation to the interpretation of the competition rules, However, any party may use other dispute resolution channels provided for by Gambling Authority or other law.
 - 4.2. This clause is separate and divisible from the rest of these rules and stays effective even if this promotional competition ends or if the rules are invalid.
 
 
- 5. Personal Information
- 5.1. The participant understands and agrees, the Promoter must collect and process personal information about the participant to conduct this promotional competition. This processing may include publication.
 - 5.2. By entering this promotional competition, the participant consent to the processing of his/her personal information in accordance with annexure A of these terms and our Heineken Beverages Privacy Policy. The Promoter may further process personal information about the participant for purposes of marketing the Promoter’s goods directly to the participant.
 - 5.3. Should the participant be a winner of the competition; the participant agrees that Promoter may publicise the details of winner. Such details include the limited personal information for this purpose and to the extent permissible in law.
 
 
- 6. General Rules
- 6.1 By taking part in this promotional competition, participants agree that they will not hold the Promoter liable for any losses, harm, damages, injury, claims, or actions related to this promotional competition. The Promoter is not liable for any failure of any technical element relating to this promotional competition that may result in an entry not being submitted.
 - 6.2 Force majeure. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
 - 6.3 These rules, including the duration of this promotional competition, can only be reasonably changed (or superseded) by the Promoter in a written revision to these rules posted on the competition website or any other potential official competition communication methods the Promoter uses to reach a majority of potential participants upon the approval of Gambling Authority.
 - 6.4 Botswana laws govern this promotional competition.
 - 6.5 If the Promoter needs to, because of legislative or regulatory reasons, the Promoter may terminate this promotional competition immediately and without notice upon the approval of Gambling Authority. If this happens participants will be notified, and they will not have any claim against the Promoter.

 - 6.7 The fairness of the draw will be determined by an independent auditing firm, Tyche consulting Pty Ltd.

Draft Data Protection Clause (Botswana Competition Terms)
- Data Protection and Privacy
- 1.1. By entering this competition, participants acknowledge and agree that Heineken Beverages (Botswana) (Pty) Ltd (“the Promoter”) may collect, process, and store their personal data for the purposes of administering the competition, verifying eligibility, and delivering prizes.
 - 1.2. The Promoter undertakes to process all personal data in accordance with the Botswana Data Protection Act 18 of 2024, which requires that personal data be processed lawfully, fairly, and transparently, and only for specified and legitimate purposes.
 - 1.3. Participants’ personal data will be retained only for as long as necessary to fulfil the competition’s objectives and will be securely deleted thereafter, unless required by law or regulatory obligations.
 - 1.4. Participants have the right to:
- - Access their personal data held by the Promoter;
 - - Request correction or deletion of inaccurate or outdated data;
 - - Object to the processing of their data for direct marketing purposes;
 - - Lodge a complaint with the Data Protection Commissioner of Botswana.
 
 - 1.5. The Promoter may share personal data with third-party service providers strictly for operational purposes related to the competition. Any such sharing will be governed by appropriate data protection safeguards.

 - 1.7. By participating, entrants consent to the processing of their personal data as described above.
