HEINEKEN® “HOT AIR BALLOON” EXPERIENCE
TERMS AND CONDITIONS

Introduction

1. The Heineken® “Hot Air Balloon” Experience (the “HAB Experience”), a premium brand activation involving hot air balloon flights is offered by Heineken Nigeria (”Heineken”), as part of its Fans Have More Friends
2. These Terms and Conditions apply to the legal relationship between Heineken and you as a participant in the HAB Experience. By accessing the registration portal, submitting details, obtaining a QR confirmation, or attending the event, each participant (the “Participant”) agrees to be legally bound by these Terms and Conditions.
3. These terms should be read alongside the Heineken Privacy Policy and general Terms of Use. Participation is strictly conditional upon full acceptance of these Terms.
4. The Organizers (Heineken Nigeria) reserve the right, at their sole discretion and without prior notice, to change, modify, or discontinue any aspect of the HAB Experience or these Terms.

Eligibility and Participation

5. Legal Drinking Age: Participation is strictly limited to individuals who are at least 18 years of age at the time of registration.
6. Verification: All users must pass the Age Gate by providing a valid Date of Birth. A valid government-issued photo ID matching the registration details is mandatory for on-site verification at Ilubirin, Lagos.
7. Exclusions: Participation is exclusive to Nigerian Breweries Plc staff, management, corporate partners, vendors, suppliers, customers and consumers.
8. Right of Exclusion: Heineken reserves the right to exclude any Participant at its sole discretion for non-compliance with these rules or any attempt to compromise the safety or integrity of the experience.
9. Participant Conduct: Participants shall always behave in a responsible and orderly manner. Any conduct deemed unsafe, disruptive, or inconsistent with event guidelines may result in immediate removal from the event without liability to the Organizers.

Registration and Attendance

10. Registration Process: To enter, Participants must complete the registration form, providing their Full Name, Mobile Number, Email Address, Gender, and Date of Birth.
11. Confirmation: Successful registrants will receive a unique registration ID and QR "Entry Pass" code via email. This QR code is mandatory for event check-in.
12. Capacity Constraints: Completion of registration does not guarantee a flight. Participation is subject to:
    • Total event capacity limits.
    • Specific date availability (including UCL Match Days or Themed Event Night).
    • Final on-site safety and vetting clearance.
13. Strict Forfeiture: Flight slots are time-sensitive. Failure to check in at the designated location in Ilubirin at the appointed time will result in the immediate and permanent forfeiture of the slot.

Health and Safety

14. Entry and Premises Risk: All Participants and attendees acknowledge that entry into and presence at the event venue is at their own risk. The venue may include temporary structures, equipment, operational zones, and other features associated with event execution. Participants agree to exercise reasonable care and comply with all safety instructions at all times. The Organizers shall not be responsible for any loss, damage, or injury arising from a Participant’s failure to comply with safety instructions or event guidelines. Participants acknowledge that the Organizers do not guarantee a risk-free environment and accept all inherent risks associated with attendance.
    Vetting Procedures: Participants must complete an initial online vetting process regarding medical, psychological, and mental fitness.
15. On-Site Assessment: The Organizers and certified pilots reserve the absolute right to refuse flight participation based on a secondary physical or mental assessment on the day of the event. The Organizers and certified pilots reserve the absolute right to refuse or discontinue participation at any stage where, in their reasonable opinion, safety, health, or regulatory concerns arise.
16. Medical Fitness: The Participant confirms that they are physically and medically fit to participate in the HAB Experience and have not been advised otherwise by a qualified medical professional. Participation is at the Participant’s own risk.
17. Alcohol and Drug Policy: A zero-tolerance policy for alcohol or drug impairment applies to all flight participants. The Organizers reserve the right to conduct breathalyzer or sobriety tests; anyone deemed impaired will be immediately disqualified without appeal.
18. Pilot Instructions: All flights are conducted by certified pilots. Their instructions must be followed strictly at all times to ensure the safety of all Participants

Experience Conditions

19. Weather Dependency: Hot air balloon operations are entirely dependent on favorable weather conditions.
20. Risk Disclosure: The Participant acknowledges that hot air ballooning involves inherent risks, including weather-related hazards, hard landings, and equipment malfunction. By registering, the Participant voluntarily assumes all such risks. The Participant further acknowledges that such risks may arise before, during, or after flight operations and voluntarily accepts full responsibility for participation. The Participant further acknowledges that risks may arise from the event environment, including crowd movement, equipment setup, and operational activities associated with the HAB Experience.

Cancellation and Changes

21. Cancellation Rights: The Organizers reserve the right to cancel, postpone, or truncate the flight experience at any time due to wind, rain, or other safety concerns.
22. No Compensation: In the event of a weather-related or safety-related cancellation, the Organizers are not obligated to provide a rescheduled slot, replacement prize, or financial compensation.

Liability

23. Liability Release:
    1. The Participant acknowledges that hot air balloon activities involve inherent risks, including but not limited to adverse weather conditions, equipment malfunction, hard landings, and other aviation-related risks.
    2. By participating in the HAB Experience, the Participant voluntarily assumes all such risks, whether known or unknown, including risks arising before, during, or after flight operations.
    3. To the fullest extent permitted by law, the Participant agrees to release and hold harmless Heineken Nigeria (NB Plc), its affiliates, event partners (including Ilubirin), Operators, pilots, contractors, and personnel from any liability for personal injury, death, property damage, or loss arising out of or in connection with participation in the HAB Experience or presence at the event venue.
    4. Nothing in this clause shall exclude or limit liability which cannot be excluded under applicable Nigerian law.
24. Indemnity: Participants agree to indemnify and hold harmless Heineken Nigeria (NB Plc), its affiliates, event partners, Operators, pilots, contractors, and personnel against any claims, demands, or causes of action arising out of or in connection with their participation in the HAB Experience, including their presence at the event venue, conduct, or failure to comply with these Terms.
25. Legal Limits: nothing in these Terms shall Nigerian law for death or personal injury caused by proven negligence to the extent such liability cannot exclude limit liability.

Operational Responsibility

26. All flight operations are conducted by licensed third-party operators and certified pilots, who retain full responsibility for flight safety and operational decisions.

Privacy and Data Use

27. Data Collection: By registering, Participants consent to the collection of first-party data for inclusion in the Heineken Nigeria Consumer database. Heineken handles all data in accordance with applicable data protection laws.
28. Marketing Communications: Participants agree to receive future promotional materials and news from Heineken and its partners, with the right to withdraw consent at any time.
29. Media Release: The HAB Experience is a premium lifestyle event that may be filmed or photographed. Participants grant the Organizers a perpetual, global, and royalty-free license to use their image and likeness in any media for promotional and marketing purposes

General Terms

30. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
    Intellectual Property: Heineken owns all intellectual property rights related to the HAB Experience and the Heineken brand. Any unauthorized reproduction of event materials is prohibited.
31. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
