HEINEKEN® ROAD TO UCL FINALS EXPERIENCE
TERMS AND CONDITIONS
- Introduction
- The Heineken® Road To UCL Finals Experience is a premium brand experience organized by Heineken Nigeria, Nigerian Breweries Plc and/or their authorized agencies, partners and service providers, as part of Heineken’s consumer engagement activities.
- These Terms and Conditions apply to the legal relationship between Heineken Nigeria, Nigerian Breweries Plc, their affiliates, agencies, partners and service providers, on the one hand, and each participant, attendee, guest or invitee at the Heineken® Road To UCL Finals Experience on the other hand.
- By accessing the registration portal, submitting registration details, obtaining a QR confirmation, presenting a QR confirmation for entry, attending the event, entering the event venue, participating in any event activity or remaining at the event venue, each participant, attendee, guest or invitee agrees to be legally bound by these Terms and Conditions.
- These Terms and Conditions should be read together with the Heineken Privacy Policy and applicable terms of use. Participation in the event is strictly conditional upon acceptance of these Terms and Conditions.
- The Organizers reserve the right, at their sole discretion and without prior notice, to modify, suspend, postpone, cancel, restrict, discontinue or vary any aspect of the Heineken® Road To UCL Finals Experience where necessary for safety, operational, legal, regulatory, security or business reasons.
- Eligibility and Participation
- Participation is strictly limited to persons who are at least 18 years old at the time of registration and attendance.
- All participants may be required to pass an age gate, provide a valid date of birth, present identification or undergo any other reasonable verification required by the Organizers.
- Participation is open only to invited or approved Nigerian Breweries Plc staff, management, corporate partners, vendors, suppliers, customers, consumers and other approved guests who meet the applicable eligibility requirements.
- The Organizers reserve the right to refuse entry to, remove or exclude any participant from the event where the participant fails to comply with these Terms and Conditions, safety instructions, age verification requirements, security protocols or any other event rules.
- Participants must behave responsibly, lawfully and in an orderly manner at all times. Any conduct considered unsafe, disruptive, offensive, unlawful, abusive or inconsistent with the event guidelines may result in immediate removal from the event without liability to the Organizers.
- Registration, Entry and Attendance
- To attend the event, participants may be required to complete the registration form and provide their full name, mobile number, email address, date of birth and any other information reasonably required for registration, verification, safety, event access and communication purposes.
- Successful registrants may receive a unique registration ID, QR code or entry pass. The QR code or entry pass must be presented at check-in and does not guarantee entry where capacity, safety, security, verification or other operational considerations apply.
- Attendance is subject to event capacity, final on-site verification, security clearance, compliance with safety requirements and the Organizers’ final admission decision.
- The Organizers reserve the right to deny entry or remove any participant where this is necessary for safety, security, legal, regulatory, operational or brand protection reasons.
- Media Release, Image Rights and Event Recording Consent
- The Heineken® Road To UCL Finals Experience is a premium lifestyle, entertainment and brand event. Participants acknowledge and agree that photography, videography, filming, livestreaming, audio recording and other forms of recording may take place before, during and after the event.
- By registering for, attending, entering, participating in or remaining at the event venue, each participant expressly consents to Heineken Nigeria, Nigerian Breweries Plc, their affiliates, brands, agencies, event partners, service providers and authorised representatives capturing, recording, using, reproducing, publishing, displaying, editing, adapting, modifying, distributing and otherwise exploiting the participant’s image, likeness, voice, appearance, name, photographs, videos, audio recordings and other recordings captured in connection with the event.
- The materials referred to in Clause 4.2 may be used for event coverage, social media posts, public relations, internal and external communications, marketing, advertising, brand promotion, commercial communications, recap videos, event highlights, media publications and other lawful promotional or commercial purposes connected with Heineken, Nigerian Breweries Plc, their brands, products, campaigns and the event.
- Participants acknowledge and agree that such materials may be used in any media, format or channel, whether now known or developed in the future, including social media platforms, websites, digital platforms, print materials, outdoor displays, press materials, paid media, internal communication channels and other communication platforms, without further notice, approval, payment or compensation.
- Participants waive any right to inspect or approve any photograph, video, recording, edit, caption, copy, creative material or final content in which their image, likeness, voice or appearance may be used, provided that such use is lawful and connected with the event, Heineken, Nigerian Breweries Plc, their brands, products, campaigns or promotional activities.
- Participants acknowledge that images and recordings may be edited, cropped, adapted, combined with other materials, captioned, reproduced, published or otherwise used by the Organizers for the purposes stated in these Terms and Conditions.
- Where a participant is to be featured prominently in a standalone campaign, billboard, testimonial, interview, influencer-style content, endorsement-style material or other content outside general event coverage and ordinary event-related promotional use, the Organizers may require a separate individual image release or consent.
- Any participant who does not wish to be photographed, filmed or recorded should notify the event organizers before entering the venue and avoid areas where photography, videography, filming or recording is taking place. However, due to the nature of the event, the Organizers cannot guarantee that a participant will not appear incidentally in general crowd footage, event coverage or event-related promotional materials.
- Participants acknowledge that crowd release notices may also be displayed at the entrance and around the event venue. Continued presence at the event after seeing such notices shall constitute acceptance of the event recording and media use terms.
- Privacy and Data Use
- By registering for the event, participants consent to the collection and processing of their personal data, including name, contact details, date of birth, registration details, event attendance information and related information necessary for event registration, verification, access control, safety, communication, consumer engagement and event administration.
- Personal data will be handled in accordance with applicable data protection laws and the Heineken Privacy Policy.
- Participants may receive event-related communications before, during and after the event, including confirmation messages, event updates, safety notices and other necessary event communications.
- Where a participant has opted in to receive promotional communications, Heineken Nigeria, Nigerian Breweries Plc and/or their partners may send promotional messages, news, offers and updates to the participant. Participants may withdraw their consent to receive marketing communications at any time through the applicable unsubscribe or opt-out channel.
- The withdrawal of consent to receive marketing communications shall not affect the lawfulness of any processing carried out before such withdrawal, nor shall it affect the Organizers’ right to use event photographs, videos or recordings in accordance with the media release provisions in these Terms and Conditions, to the extent permitted by law.
- Health, Safety and Event Risk
- Participants acknowledge that entry into and presence at the event venue is at their own risk.
- The event venue may include temporary structures, lighting, sound systems, electrical installations, production equipment, crowd movement, restricted areas, operational zones and other features associated with event execution.
- Participants agree to exercise reasonable care, comply with all safety instructions, follow directions from event officials and avoid restricted or operational areas.
- Participants acknowledge that the Organizers do not guarantee a risk-free environment and accept the ordinary and inherent risks associated with attendance at a public event.
- The Organizers shall not be liable for any loss, damage, injury or expense arising from a participant’s failure to comply with safety instructions, security protocols, event guidelines or these Terms and Conditions.
- Event Changes, Cancellation and Force Majeure
- The Organizers reserve the right to cancel, postpone, suspend, delay, restrict, relocate, truncate or modify the event at any time due to weather, safety, security, regulatory, operational, technical, force majeure or other reasonable considerations.
- Where the event is cancelled, postponed, suspended, delayed, restricted, relocated, truncated or modified, the Organizers shall not be obligated to provide compensation, damages, replacement benefits, financial reimbursement or any other remedy to participants, except where expressly required by applicable law.
- Liability Release and Indemnity
- By participating in the event, each participant voluntarily assumes all ordinary and inherent risks associated with registration, entry, attendance, participation and presence at the event venue, whether such risks arise before, during or after the event.
- To the fullest extent permitted by law, each participant agrees to release and hold harmless Heineken Nigeria, Nigerian Breweries Plc, their affiliates, directors, officers, employees, agencies, event partners, service providers, contractors and authorized representatives from liability for personal injury, property damage, loss, expense, claim or damage arising out of or in connection with the participant’s attendance at, participation in, or conduct at the event.
- Participants agree to indemnify and hold harmless Heineken Nigeria, Nigerian Breweries Plc, their affiliates, agencies, event partners, service providers and authorized representatives from and against any claims, demands, losses, liabilities, damages, costs or expenses arising from their breach of these Terms and Conditions, misconduct, unlawful conduct, failure to comply with safety instructions, or misuse of event materials.
- Nothing in these Terms and Conditions shall exclude or limit any liability which cannot be excluded or limited under applicable Nigerian law, including liability for death or personal injury caused by proven negligence to the extent such liability cannot lawfully be excluded or limited.
- Intellectual Property
- Heineken, Nigerian Breweries Plc and/or their licensors own all intellectual property rights associated with the Heineken brand, the event, event materials, campaign assets, logos, designs, content, creative materials and related brand properties.
- Participants shall not reproduce, publish, exploit, modify, sell, distribute or use any event materials, brand assets, logos, designs or intellectual property without prior written approval from the Organizers.
- Participants may take personal photographs or videos at the event for private and non-commercial use only, unless otherwise restricted by the Organizers. Such personal content must not be used in any unlawful, defamatory, misleading, offensive, commercial or brand-damaging manner.
- Participant Conduct and Content
- Participants shall not engage in conduct that may endanger themselves or others, disrupt the event, damage property, breach applicable law, infringe the rights of others, or negatively affect the reputation of Heineken, Nigerian Breweries Plc, their brands, partners or the event.
- The Organizers reserve the right to remove any participant who breaches this clause or any other part of these Terms and Conditions.
- Participants shall not post, publish or share any event content in a manner that is false, misleading, offensive, unlawful, defamatory, discriminatory, damaging to the Heineken brand or inconsistent with responsible drinking standards.
- Responsible Drinking
- Heineken promotes responsible drinking. Participants are expected to consume alcoholic beverages responsibly and in accordance with applicable law.
- The Organizers reserve the right to refuse service, restrict access to alcohol, or remove any participant who appears intoxicated, behaves irresponsibly or poses a risk to themselves or others.
- General Terms
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
- If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
- The failure of the Organizers to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or any other provision.
- These Terms and Conditions constitute the applicable terms governing registration, entry, attendance and participation in the Heineken® Road To UCL Finals Experience.
