You must accept the following terms and conditions to enter the Export promotion run in conjunction with EVT New Zealand to stand a chance to win a double pass to Sail GP (“Promotion”).  

The “Sponsor” refers to DB Breweries Limited, 1 Bairds Road, Papatoetoe, Auckland 2025.  The Sponsor can be contacted on 0800 102 337 free of charge from landlines within New Zealand. 

The “Promoter” refers to EVT New Zealand.

Entry into the Promotion is deemed acceptance of these terms and conditions.  

SPECIFIC TERMS AND CONDITIONS  

1. The Promotion commences at 12.01am on 2^nd December 2024 and continues until 11.59pm on 20^th December 2024 (“Promotional Period”).  No entries will be accepted outside the Promotional Period. 

2. The promotion is open to New Zealand residents only. Employees of the Promoter / Sponsor and any agency involved with this promotion, and the immediate families of such employees, are not eligible to enter.

3. The promotion commences and finishes on the dates specified on point-of-sale material in each store. Any entries submitted outside of these dates are not eligible.

4. Participants must be aged 18 years of age or above, including anyone participating in the prize with the winner. Both the winner and their companion need to be aged 18  years of age or above.  

5. Participants must be able to attend Sail GP on Saturday 18^th January 2025 (the “Prize Date”).

6. Winners will selected at random.

7. To participate in the promotion, scan the QR code situated on the point-of-sale material, and complete the webform with your details. 

8. There is no limit on the number of entries that may be made in a day during the Promotional Period. 

PRIZE: 

9. The prize package (“Prize”) is a double pass to Sail GP;
10. Two (2) Waterfront Grandstand tickets to Sail GP;
11. Two (2) night’s accommodation at Rydges Aucklandin a Deluxe King room on Friday 17 January 2025 and Saturday 18 January 2025
12. Full Buffet Breakfast at The CUT Restaurant and Bar;
13. $150 food and beverage voucher for The CUT Restaurant and Bar;

10. The Winner and their companion must make their own travel arrangements to get to Auckland.
11. The Winner must follow the instructions given by the Promoter / Sponsor on how to claim the Prize. Proof of age may be required, and the Winner and their companion may be required to sign a participation agreement and /or deed of release before redeeming the Prize.
12. The Winner will be notified as soon as reasonably practicable following the Prize draw. Reasonable efforts will be made to contact the Winner using the Winner’s contact details provided to the Promoter via the digital form. The Promoter reserves the right to redraw the Prize if a winner cannot be contacted within a reasonable period, as determined by Promoter / Sponsor at its sole discretion.
13. The promoter reserves the right to reallocate the Prize if it has not been validly claimed by 11.59pm on [23rd December 2024].
14. Any photography obtained during the Prize will be retained by the Sponsor who reserves the right to use any imagery for further promotion. 

PRIZE AND TRAVEL CRITERIA: 

15. The prize does not include flights or travel costs.
16. No alternative prize dates will be offered, and Prize will be forfeited if the Winner and their companion cannot travel during the Prize Period, and the Promoter reserves the right to select an alternate winner. 
17. The Prize is not transferable, exchangeable, or redeemable for cash.
18. The Prize includes GST and taxes. 
19. The Winner and their companion will be responsible for any expenses not expressly included in the Prize including expenses such as spending money on personal expenses, meals, drinks, transport, laundry charges, activities, incidentals, taxes (excluding departure and any other flight associated taxes included within the Prize), gratuities, services charges, travel insurance and all other ancillary costs associated with redeeming the Prize. 
20. If the Prize (or part of the Prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with an alternative that is of equal value and/or specification, subject to any written directions from a regulatory authority. 
21. The Prize must be taken as stated and no compensation will be payable if the Winner is unable to use the Prize as stated. 
22. The Winner and their companion will at all times act responsibly so as not to harm the reputation of the Promoter and/or the Sponsor while taking up the Prize. This includes consuming alcohol responsibly.

WINNING THE PRIZE: 

24. On Monday the 23rd of December 2024, the Prize draw will be conducted whereby the Promoter will randomly select one entry from all valid entries. 
25. Between Monday the 23^rd of December 2024 and Wednesday 25^th of December 2024, the Promoter / Sponsor will call the selected entry using the contact details provided. The Promoter / Sponsor will attempt to call the entrant a maximum of two times. If the Promoter / Sponsor is unable to contact the entrant, the Prize is forfeited and the Promoter / Sponsor may select another entrant. 
26. To claim the Prize, the Winner must provide the Promoter / Sponsor with their email address, mobile phone number, and confirmation of their eligibility i.e. copy of their New Zealand driver’s licence, passport or HANZ (R18 Card). If this information is not provided within two (2) days from the requested date, the Winner will be deemed to have forfeited the Prize. 
27. The Prize details will be arranged directly between the Winner, the Promoter, and the Sponsor, and the Winner shall promptly provide the Promoter / Sponsor with all information requested. 
28. All prize dates during the Prize Period are subject to change and may be cancelled at any time due to reasons beyond the Promoter’s / Sponsor’s control (such as adverse weather conditions). 
29. The Promoter / Sponsor takes no responsibility for any failure or delay in delivering the Prize but will provide all reasonable assistance in cases where the Prize is not received by the Prize winner. 
30. Neither the Promoter nor Sponsor nor any other person or party associated with this Promotion will be liable to any person in any way in relation to this Promotion including, without limitation, any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) due to any changes to the activity schedule for any reason, including changes to the date, time, location, any death or personal injury howsoever suffered or sustained, the cancellation or postponement for any reason of the Prize and the quality of goods or services supplied by any third party, except for any liability that cannot be excluded by law.

OTHER TERMS AND CONDITIONS: 

31. These terms and conditions may be amended and the Promotion terminated at any time by the Promoter and/or Sponsor. 
32. The Promoter’s / Sponsor’s decisions on all entry and promotion matters are final and no correspondence will be entered into. 
33. All details and instructions form part of the terms and conditions of the promotion.
34. The Winner and their companion taking up the Prize is subject to the terms, conditions and restrictions of the airline provider, the accommodation provider, the venues and any other third party service providers responsible for the Prize. The Winner and their companion agree to comply with all terms and conditions and any reasonable instructions given by such third parties. 
35. The Winner and their companion grant the Promoter / Sponsor permission to share their personal information with the Promoter / Sponsors and all third-party service providers appointed to provide the Prize for the purpose of delivering the Prize.
36. By accepting the Prize, the Winner and their companion grant the Promoter / Sponsor permission to collect and use their name, photograph, voice and film recordings in which they appear, in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use. This includes the right to use on the Promoter’s and/or Sponsor’s websites, Facebook pages, on air and other publications of the Promoter and/or Sponsor. 
37. Entries must be made by individual consumers. No entries from trade customers, agents, organised groups or other third parties will be accepted.  At the discretion of the Promoter / Sponsor, offenders may be prosecuted.
38. The Promoter / Sponsor may refuse to award a prize to any participant if, in the Promoter’s / Sponsor’s sole opinion, that participant has violated the terms and conditions of the Promotion or has gained an unfair advantage in participating in the Promotion.
    
    

Except for any liability that cannot be excluded by law, the Promoter / Sponsor (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies), excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's / Sponsor’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected ; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by a claimant or entrant; or (f) use of a prize.
