Welcome to our website dedicated to our brand Heineken® (the “Website”). You should be of legal drinking age in your country to visit the Website.

These Terms and conditions together with our Privacy Policy and Cookie Policy (the “Terms”) govern your use of this Website.

Applicability

These Terms apply to all visits to and all use of this Website of Heineken International B.V., located at Tweede Weteringplantsoen 21, 1017 ZD Amsterdam, the Netherlands ("HEINEKEN"), as well as to all information, recommendations and/or services provided you on or through this Website (the "Information").

By using this Website you agree to the applicability of these Terms. We note that these Terms may be changed over time. Such changes shall be effective immediately upon the posting of the modified Terms. Users of the Website are advised to regularly read the Terms for possible changes.


Information and Liability

The Information is for general information purposes only and does not constitute advice. HEINEKEN shall not be liable for any damages resulting from the use (or inability to make use) of this Website, including any incorrectness or incompleteness of the Information, unless such damage is the result of any wilful misconduct or gross negligence on the part of HEINEKEN.

HEINEKEN shall furthermore not be liable for damages that may result from the use of electronic means of communication, including, but not limited to, damages resulting from the failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.

Intellectual property rights

The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by HEINEKEN, its licensors or other providers of such material and are protected by copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

You can use the Website only for purposes in line with these Terms. You are permitted to make copies of (parts of) the Website for personal use. You must not use any part of the content on our Website for other purposes without obtaining a written licence from us.

Indemnification

You agree to indemnify us from and against any actions, claims and liabilities arising out of or relating to your violation of these Terms or any unlawful use of the Website.

Miscellaneous

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

These Terms are governed by Dutch law. Any dispute or claim arising out of or in connection to the use of the Website will be settled by the courts of Amsterdam, the Netherlands.

DB’s General Terms and Conditions for Competitions

  1. These general terms & conditions are applicable to all competitions run by DB Breweries Limited via this website unless otherwise specified.  By entering into the applicable competition (“Competition”), you confirm that you accept these terms and conditions. In the event of any inconsistency between these general terms and conditions and the specific terms and conditions for any Competition, the specific terms and conditions will take precedence.
  2. The Promoter is DB Breweries Limited (“Promoter”), 1 Bairds Road, Otahuhu, Auckland.  The Promoter can be contacted on 0800 102 337 free of charge from landlines within New Zealand.
  3. To participate in and/or claim a prize in the Competition, you must be a New Zealand citizen or permanent resident aged 18 years or over.
  4. The Promoter’s and its associated companies’ employees, agencies and contractors, or anyone else professionally involved in the Competition, and their immediate families (including spouses, grandparents, parents, children and grandchildren) are unable to participate in the Competition.
  5. The applicable promotional period and the dates of prize draws comprising the Competition will be as stated in the specific terms and conditions for each Competition. Unless otherwise stated in the specific terms and conditions, entries will close at midnight on the closing date of the Competition.  No entries will be accepted outside of the applicable promotional period. 
  6. Any entries that are not made by an individual consumer in the method prescribed above in the Competition Details, will be invalid. Any attempts to deceive or increase the chances of winning by making automatic computer generated entries, using organised groups or third parties and/or by any other means, may be prosecuted by the Promoter, at their absolute discretion.
  7. Without prejudice to any of its other rights, the Promoter reserves the right to disqualify any participant for fraud and/or reject fraudulent entries as determined in its sole discretion.
  8. The Promoter will endeavour to ensure that all relevant means of entry into the Competition are available at all times during the promotional period, but cannot guarantee availability and is not liable for any disruptions or system failure.  The Promoter reserves the right to suspend or cease any means of entry into the Competition at its sole discretion.
  9. Unless multiple entries have been allowed in the Competition Details, the Promoter reserves the right to remove duplicate entries.
  10. Incomplete or illegible entries or those not submitted in accordance with the entry instructions will not be accepted.  The Promoter is not responsible or liable for any lost, incorrect, misdirected or any entries at all that are not received by the promoter.
  11. In the event of a dispute the Promoter’s decision is final and binding and no correspondence will be entered into.
  12. The Promoter reserves the right at any time to suspend or modify the Competition, or these terms & conditions, without prior notice and for any reason whatsoever at its discretion.
  13. The Promoter may refuse to award a prize to any participant if, in the Promoter’s sole opinion, that participant has violated the specific and/or general terms and conditions of the Competition or has gained an unfair advantage in participating in the Competition.
  14. The Promoter can contact a participant through any of the contact details provided.
  15. Prize winners will be notified as soon as reasonably practicable following any draw or award.  The Promoter reserves the right to redraw or reallocate any prize if a winner cannot be contacted within a reasonable period, as determined by the Promoter at its sole discretion.
  16. Prize winners and their companions may each be required to sign a Participation Agreement in order to take a prize.
  17. The promoter reserves the right to cancel, change, substitute or remove the prize at its absolute discretion. The Promoter will not be responsible for the cancellation or postponement of any prize.
  18. Participants agree that the Promoter (and its agents and contractors) may collect and retain their personal information in order to conduct the Competition and for future promotions carried out by the Promoter and its associated companies. Participants have the right to request access to their personal information held by or on behalf of the Promoter and to update or to remove any such information. All such requests should be directed to the Promoter in writing at the address set out above.
  19. By participating in the Competition, participants consent to the use of their name and photograph for any promotional purposes carried out by the Promoter. Prize winners may be required to take part in any publicity accompanying or resulting from the Competition. Unless otherwise specified by the Promoter, no additional compensation will be provided by the Promoter for such participation.
  20. The Promoter will not be liable for any loss or damage whatsoever incurred by any participant (including but not limited to any indirect or consequential loss).  All prizes are taken entirely at the participant’s own risk.  Participants indemnify the Promoter against any claim for accident or loss of life, personal injury, property damage or other loss, cost or expense arising in connection with the Competition or any prize.
  21. The promotion is in no way sponsored, endorsed, administered by or associated with Facebook/Instagram, and Facebook/Instagram has no liability whatsoever (and is released from any liability) to any entrant in this competition.
  22. The Promoter makes no product representation or warranties, expressed or implied and disclaims any and all liability, as to the condition, quality, merchantability or fitness for use of the prize.
  23. Failure to comply with any of the Terms and Conditions will result in an invalid entry and disqualification.
  24. All Terms and Conditions are governed by the laws of New Zealand.
  25. No part of this page may be distributed or copied for any commercial purpose. No other use (including publishing, copying or reformatting) of the page or its content is permitted without the Promoter’s prior written consent.
  26. Any information or material that you submit to the Promoter, including photos, ideas and suggestions, will be treated as non-confidential and non-proprietary and will become the property of the Promoter so that they may reproduce, publish, disclose, modify or adapt it without restriction or payment to you.
  27. The inclusion of a third party website link on this page should not be taken as an endorsement by the Promoter of that website. The Promoter accepts no responsibility for the content or functionality of a third party website, or for the quality of products or services which may be offered on that website.
